Terms of Service
These Terms of Service ("Terms") govern your access to and use of the Boaterian mobile application and related services (collectively, the "Service") operated by Boaterian LLC ("Boaterian," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.
1. Eligibility
You must be at least 18 years old and a licensed or professional marine surveyor, appraiser, or other qualified marine professional to use the Service.
2. Account Registration
You may sign in with Apple, Google, or email. You are responsible for maintaining the confidentiality of your credentials and all activity under your account. Notify us immediately at mklappdesign@gmail.com if you suspect unauthorized access.
3. Acceptable Use
You agree not to:
- Use the Service to produce fraudulent or misleading survey reports;
- Upload content that infringes any third-party intellectual property or privacy rights;
- Attempt to reverse-engineer or decompile the Service;
- Use automated means (bots, scrapers) to access or extract data from the Service;
- Resell or sublicense access to the Service without our written permission.
4. Subscription and Payment
Certain features may require a paid subscription. All fees are in U.S. dollars and non-refundable except as required by law. We reserve the right to change pricing with reasonable notice.
5. Your Content
You retain ownership of all survey data, photos, documents, and reports you create ("Your Content"). By using the Service you grant Boaterian a limited license to store, process, and display Your Content solely to provide and improve the Service. We do not sell Your Content to third parties.
6. AI-Assisted Features
Boaterian uses AI to assist with valuations and report generation. AI outputs are for informational purposes only. You are solely responsible for reviewing, verifying, and signing off on any report before delivering it to a client. AI-generated content does not constitute a professional appraisal or survey opinion on its own.
7. Third-Party Services
The Service integrates with Clerk, Microsoft Azure, Anthropic, and boat-valuation data sources. Your use is subject to their respective terms. We are not responsible for the availability or accuracy of third-party data.
8. Intellectual Property
All software, design, trademarks, and other materials comprising the Service (excluding Your Content) are the property of Boaterian LLC or its licensors. Nothing in these Terms transfers any intellectual property rights to you.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BOATERIAN LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.
11. Indemnification
You agree to defend and hold harmless Boaterian LLC from any claims, damages, or expenses arising from your use of the Service, Your Content, or your violation of these Terms.
12. Account Termination
You may delete your account at any time from the Account tab in the app. We may suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Service ceases immediately.
13. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date above. Continued use after changes take effect constitutes your acceptance of the revised Terms.
14. Governing Law
These Terms are governed by the laws of the State of Florida. Any disputes shall be resolved in the state or federal courts located in Florida.
